תוס' ד"ה הא

הא תבריה רבי עקיבא לגזיזיה – For ר"ע broke the strength of his fist

Summary: תם דאזיק אדם cannot be included in the אבות דר"ח, for since it pays מגופו it is not similar to the other אבות who are required to pay ממיטב.

תוס' ד"ה האונס

האונס והמפתה והמוציא שם רע דממונא הוא – One who forced or seduced or slandered which requires monetary restitution

Summary: The גמרא mentions מוצש"ר on account of אונס ומפתה; there was no thought that מוצש"ר should be included, since it is solely a קנס payment.

המטמא והמדמע – One who defiles or mixes

Summary: Another reason why מטמא ומדמע are not included in the אבות דר' אושעיא is because they are פטור בשוגג.

דאי שמיה היזק - For if it is considered damage

Summary: The גמרא is attempting to reconcile חזקיה (who maintains היזק שאינו ניכר שמיה היזק), with the ברייתא of his father ר"ח, who enumerates המטמא והמדמע והמנסך.

וקתני היזק דלא מינכרא – And he mentions a damage which is not apparent

Summary: It is appropriate to mention various types of היזק (even if they are similar) if these various types are mentioned in a משנה.

Summary: The term למעוטי means that we are not discussing those אבות; but not that there is any disagreement whether they are אבות.

למעוטי מוסר כולי – To exclude an informer, etc.

Summary: The גמרא could have stated that the מניינא דר"ח excludes כופר ושלשים של עבד, and they are not mentioned for ר"ח is not discussing damages which involve killing. (מוסר (ומפגל are חייב even למ"ד דלא דאין דינא דגרמי on account of קנס.

דיבורא דאית ביה מעשה – Speech that contains within it action

Summary: The מעשה of מוצש"ר is; either the בעילה, or the hiring of the witnesses.

כולם כאבות לשלם ממיטב – All of them are like the אבות in regards to pay from the choicest

Summary: It is necessary to designate the מזיקים of ר"א ור"ח with the name אבות so that it is clear that they are similar to the אבות of the משנה in regards to paying from מיטב.

תחת נתינה כולי – In place of, giving, etc.

Summary: The גז"ש of לא תחוס עיניך (by בושת ועדים זוממים) is limited that בושת pays money (but not that עדים זוממים pay ממיטב). The לימוד of נפש בנפש teaches us that עדים זוממים pay ממיטב even if their falsely accused would not pay ממיטב.
