תוס' ד"ה חומר

חומר בשור מבאש – The stringency by an ox is more than by fire

Summary: The קולא of אש not being a בע"ח, is included in the קולא of מסרו לחש"ו פטור.

שייר טמון – He omitted טמון

Summary: בור is פטור for all damages to inanimate objects (including grain [and water]), and is only חייב for damages to a בעל חי.

תוס' ד"ה ליחכה

ליחכה נירו וסכסכה אבניו – It scorched his plowed field and charred his stones

Summary: According to רש"י the meaning of משא"כ בבור is that damages to קרקע (such as דש בנירו or ליחכה נירו וסכסכה אבניו) are inapplicable by בור. However, תוספות challenges and asks that the גמרא could have offered more common examples that are שייך by אש and not by בור, such as burning a house. תוספות explains משא"כ בבור to mean that בור is פטור when something unusual happens by a בור; if it killed 'בפחות מי.

שהשור חייב בו פסולי המוקדשין מה שאין כן בבור – For an ox is liable for unfit sacrifices; which is not the case by בור

Summary: The לימוד of והמת יהיה לו which teaches us למי שהמת שלו is referencing only the (שור (וחמור that is written in the פסוק but not the אדם.

Summary: If one completes an existing pit to a depth of ten טפחים he is exclusively חייב, both for damages and death.

Summary: The גמרא is not satisfied with the example of ובא אחר והשלימו לעשרה, for either it is not according to רבי or it is discussing מיתה and not נזיקין.

תוס' ד"ה כגון

כגון פפא בר אבא – For instance פפא בר אבא

Summary: According to the רשב"ם the גמרא mentions כגון פפא בר אבא to explain why they are חייב; for if regular people break a bench while sitting on it they are פטור since it is considered מתה מחמת מלאכה. However ר' עזריאל and the ר"ת disagree with this ruling and maintain that פפא בר אבא is mentioned to explain that the others are פטור when he leaned on them, since they could not stand up.
